Scope of Services

The agency provides real estate services including, but not limited to:

  • Property listings (for sale or rent)
  • Property searches and acquisitions
  • Mediation between buyers and sellers, landlords and tenants
  • Marketing and promotion of properties
  • Assistance with administrative formalities (e.g. contracts, certificates)

The specific services rendered depend on the mandate signed between the client and the agency.

Agency Mandate

Engaging our services requires a signed mandate, which may be exclusive or non-exclusive. The mandate outlines:

  • Duration of the agreement
  • Scope of services
  • Commission terms
  • Responsibilities of both parties

The client agrees not to bypass the agency during the mandate’s validity and for a reasonable period thereafter (typically six months).

Obligations of the Agency

The agency undertakes to:

  • Act with diligence, transparency, and in the client’s best interests
  • Provide accurate and honest information on all listed properties
  • Conduct necessary verifications (subject to availability of public records or third-party data)
  • Promote the client’s property using appropriate and effective marketing tools

Obligations of the Client

The client agrees to:

  • Provide complete, truthful, and up-to-date information
  • Enable the agency to fulfil its role under the agreed mandate
  • Notify the agency of any direct contact with potential buyers or tenants
  • Avoid listing the property under different terms without informing the agency

In the case of an exclusive mandate, the client also agrees not to work with other agencies or proceed with a direct sale or rental.

Confidentiality and Data Protection

All personal and property-related data is managed in compliance with applicable data protection laws (e.g. GDPR in the EU). Information is only shared with third parties (e.g. prospective buyers, notaries) when necessary to perform the agency’s duties.

Clients may request access to, correction of, or deletion of their personal data by contacting the agency.

Liability

The agency cannot be held responsible for:

  • Misrepresentation by third parties
  • Hidden defects in properties
  • Delays or failures caused by events beyond its control (e.g. force majeure)

The agency acts as an intermediary unless otherwise stated in the mandate.

Termination

Either party may terminate the mandate in writing, respecting the notice period defined therein. Termination does not nullify the agency’s right to a commission if a transaction is completed with a contact made during the mandate.

Applicable Law and Jurisdiction

These terms and any related disputes are governed by the laws of Indonesia.

In the event of a dispute, the parties will seek an amicable resolution. If no agreement is reached, the competent courts of Bali shall have exclusive jurisdiction.
